This Tuesday, after a long delay in its parliamentary processing, the Congress of Deputies will give the green light to the Law on Measures to Prevent and Combat Tax Fraud, which will have the votes of the 2 parties of the governing coalition and the support of almost the entire hemicycle, with the exception of the extreme right. With this vote, the rule will be at the expense of its final approval in the Senate.
Despite the almost unanimous support, the measure builds up 7 months late since its approval by the Council of Ministers as the draft law, although the rules will be approved almost 3 years after the Government —then the PSOE ruled in minority after the motion of censure with which Pedro Sánchez replaced Mariano Rajoy as president— announced in July 2018 that it was working on this legislation.
Maria Jesus Montero, who was by then Finance minister, said in his first appearance that would lead to the Congress "in the coming weeks," a new law on prevention and fight against tax fraud to pursue large fraudsters, promising to include the prohibition of amnesties, tax or modify the list of defaulters to the Treasury. However, the rule has been made to wait finally 2 and 10 months and will be approved 2 legislatures after having been initially announced.
However, despite the wait, most of the measures proposed during the beginning of the elaboration of the new law against tax fraud have remained in their articulations and have survived the negotiations and the phase of presentation of amendments in Parliament, in which PP, PNV and PDeCAT, in addition to the PSOE, have included new aspects of the new fraud prevention regulations.

One of the most striking measures with the greatest social impact within the new law is the establishment of new limits for the use of cash to combat the underground economy, which each year subtracts 270,000 million euros from the State coffers.
In principle, the rule reduces from 2,500 to 1,000 euros the cash payments for entrepreneurs and self-employed, while maintaining at 2,500 euros the cap for individuals, although the Government has not ruled out reducing this limit in the future to facilitate the gradual elimination of cash payments in Spain. On the other hand, the limit for individuals with tax domicile outside Spain also drops from 15,000 to 10,000 euros.
In 2019, the Government announced that the Tax Agency would intensify control over fintech and business accounting technology solutions, noting the need to restrict the use of tools that facilitate accounting fraud, especially in VAT collection.
Thus, the law prohibits the use of so-called dual-use software that some companies use to hide a second parallel accounting and therefore declare less income and pay less taxes and requires that computer systems used in business accounting have a certification from the Ministry of Finance.
As a way to encourage voluntary compliance with the tax obligations of taxpayers, the law includes moderating penalties for taxpayers who submit their income tax, VAT or Corporate tax returns after the deadline provided that they have not received a request from the Tax Agency. In this way, the surcharge is increased from 5% to 1%, to which a further 1% is added for each month of delay in the submission of the required declaration.
Another of the most publicized within the law's anti-fraud is the prohibition of new amnesties tax as enacted in 2012, which was declared unconstitutional by the Spanish courts in 2017, although no retroactivity with regard to the fortunes enjoying this regularization express.

In tax matters, the anti-fraud law will include few new developments, which also focus on the conditions to access specially protected regimes, such as that of listed real estate investment companies or socimis, to which the new rule imposes the obligation to pay 15% in taxes on undistributed profits that come from income that has not been included in the taxation of Corporate tax.
In the same line as the previous measure, to investment companies in variable capital or sicav new requirements are applied within the new law, consisting of a minimum investment of 2,500 euros, or 12,500 euros for a sicav by compartments, to account for a share within the company, since they require 100 participants at least to enjoy the exemption of 99% of Corporate tax, according to Europa Press.
In addition, companies that are dissolved by this legal change will have a transitional regime of 6 months in which they will be exempt from taxes, including the Tobin rate, as long as they reinvest their assets.
Finally, the new anti-fraud law offers new powers to tax inspectors regarding the judicial authorizations they must request before registering a taxpayer's address, which will be expedited while maintaining judicial guarantees. With this measure, the Executive seeks to break the downward trend in the investigation of tax crimes, which the union of technicians of the Ministry of Finance, Gestha, has denounced has been reduced by 85% in the last 10 years.
Similarly, the rule originally included the reinforcement of the staff of the Tax Agency and the creation of a higher body of Treasury technicians. It is still unknown whether they will be part of the new law.
